McDonald Transport has been ordered to pay a driver £8,000 compensation for wrongful dismissal. Alan Smith, 60, was sacked from his job at the Dundonald, Ayrshire firm in a dispute over driving hours. Smith told the tribunal that he had just returned from a 17-day trip to France and had been told he would be off for the following three days so as to ensure he was within driving limits.
The dispute arose when he was called in the following day by managing director Colin McDonald to unload a truck. When he refused he was verbally sacked over the phone and his P45 forwarded in the post without further explanation. His solicitor wrote asking for an explanation but received no reply. In its ruling, the industrial tribunal said that proper procedures had not been followed.
