A firm that continued to operate trucks despite a warning from its local traffic area office not to do so has won its appeal to carry on operating.
Bedworth Transport Services - formed after BBS Transport went bust - had gone to the transport tribunal after a decision by David Dixon, West Midlands traffic commissioner.
Dixon had held that the firm's directors had lost its good repute and refused to grant a licence. The application was for 16 trucks and 14 trailers.
But the Transport Tribunal, with Frances Burton presiding, allowed the appeal on condition that a transport manager acceptable to Dixon be appointed from outside the present board of directors by February 19.
Before the Tribunal, Mark Laprell argued that BBS had suffered a sudden change in its customer profile and Dixon had given insufficient credit to the directors' honesty.
The tribunal said that it appeared that Dixon had considered the directors to be honest and they had relied on advice from the TAO that they could run for a few days on the old BBS licence whilst a new one was sought.
