ICL driver claims unfair dismissal

05 September 2007

A driver claiming unfair dismissal has accused his former managing director of fabricating threats to justify his dismissal at a Birmingham employment tribunal. Roy Tierney, who worked for International Container Logistics, instructed his solicitor to accuse managing director Amerjit Singh of making up the complaints and complaining to police.

Singh said Tierney had asked for £100 to "walk away quietly" at a disciplinary hearing. He said he later received threats and contacted the police.  Tierney was sacked after repeatedly being late for work. Singh said the driver had also forgotten his keys on one job, run out of diesel on another and even failed to turn up on one occasion.

Tierney denied making threats. He refuted Singh's claims that he was late for jobs. Tierney's solicitor said he had complained about driving a lorry with a defective fuel tank and working 55 hours a week. The driver also objected to not having payslips or enough overnight allowances. The hearing was adjourned to enable more witnesses to give evidence.
