Drivers face more penalty points

25 September 2007

From this week the maximum penalty for failing to disclose who was driving a vehicle at the time of an alleged offence doubles to six points. Derek Millard-Smith, a specialist in regulatory law at Manchester solicitors Pannone LLP, says: "It will raise difficulties for drivers who were not driving at the time of the offence and are genuinely unable to identify who was.

"The changes may encourage situations  where a registered keeper unable to identify the driver will accept three points rather than risk six, even though he or she didn't commit the offence." This change in the law could be particularly tricky in fleets that regularly swap trailers. If a numberplate is forgotten on the back of a trailer and pulled by a different tractor, driver identification could be very complicated.
