Midlands operators alerted to new legislation

Operators attending the Commercial Motor legal seminar held in the Midlands last week were alerted to a number of important pieces of legislation about to affect the industry. James Backhouse, a director at Backhouse Jones solicitors, told delegates at the ATS Euromaster-sponsored event to take note of the new paid holiday entitlement, which became effective on 1 October.

Employees are now entitled to 4.8 weeks' statutory holiday per year, rising to 5.6 weeks from April 2009. "This paid  holiday should be based on the average weekly pay, not basic pay," said Backhouse. "If you're paying bonuses then this needs to be factored into that average." Backhouse also alerted delegates to new laws regarding graduated fixed penalties, corporate manslaughter and EC drivers' hours rules.
