North Western Traffic Commissioner Beverley Bell has reserved her decision over a licence held by Chorley, Lancashire-based DP Cold Planing following breaches of a condition imposed on the O-licence.
The condition limits vehicle movements at the firm's operating centre at Chapel Lane to between 2300 and 0600 hours. However, in April 2006, traffic examiner Peter Ilsley received a complaint that the condition was being breached.
Following a further complaint, he visited the company in July 2006. An analysis of 80 tachograph charts revealed nine occasions when the condition had been breached.
He also pointed out a number of drivers' hours infringements including failures to record positioning journeys. Similar problems were also found during an investigation in January 2007, along with amounts of missing mileage on the tachograph charts.
The company was seeking to increase the licence authorisation from six vehicles and four trailers, to 10 vehicles and four trailers, and to have the timing condition lifted.
However, the company said it had recently submitted an application for an additional operating centre at the Crosse Hall Industrial Estate and if that was granted it would not be necessary to vary the condition in relation to Chapel Lane. The Commissioner is to announce her decision in writing at a future date.
